All services are professional consulting services. They are not legal, financial, psychological, or medical services.
Our services are designed for business leaders and organizations.
By using this website or purchasing services, you confirm that:
You are at least 18 years old.
You have authority to act on behalf of your organization (where applicable).
You will use the services for lawful business purposes.
The 5D Performance Model™, including but not limited to:

Executive Briefing™
Coherence Mapping™
Coherence Leverage Point™
and all related frameworks, methodologies, diagnostic structures, written materials, facilitation architectures, proprietary language, and conceptual systems (collectively, the “5D Intellectual Property”) are the exclusive intellectual property of Oana Garcia, the creator and originator of the methodology.
All rights, title, and interest in and to the 5D Intellectual Property are and shall remain vested in Oana Garcia.
Build Know How SRL operates under authorization and license from Oana Garcia to use, deliver, commercialize, and distribute the 5D Intellectual Property through its consulting practice, Synergetic Solutions.
Nothing in these Terms transfers ownership of the 5D Intellectual Property to any client or third party.
Clients are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use materials provided during an engagement solely for internal organizational purposes.
Clients may not:
Reproduce, distribute, publish, or commercialize materials.
Use the 5D Intellectual Property to offer consulting, coaching, facilitation, or advisory services to third parties.
Reverse engineer, replicate, or create derivative methodologies.
Represent themselves as certified or licensed providers of the 5D Performance Model™ unless formally authorized.
Any use beyond internal organizational application requires a separate written licensing agreement.
Oana Garcia reserves the right, at her sole discretion, to license, certify, or authorize third parties to use the 5D Performance Model™ methodology under separate licensing agreements.
Such authorization, if granted, will be formalized through written contractual arrangements specifying scope, rights, restrictions, and quality standards.
No participation in workshops, advisory engagements, coaching programs, or training sessions grants implicit certification, authorization, or rights to commercially apply the methodology.
All TRACOM materials, assessments, platforms, and related intellectual property remain the exclusive property of TRACOM and are delivered under certified facilitator agreements.
Such materials may not be reproduced, redistributed, or commercialized by clients without proper authorization.
Payments may be processed via:

Other designated payment providers
We do not store full credit card details.
Payment terms, cancellation policies, and refund conditions are specified:
At the point of purchase (for digital services)
In written proposals or signed agreements (for consulting and enterprise engagements)
Unless otherwise specified:
Digital assessments are non-refundable once accessed.
Coaching and consulting sessions are non-refundable once delivered.
Speaking engagements and workshops require written cancellation terms in advance.
Live sessions (briefings, workshops, coaching, speaking engagements) may be rescheduled with reasonable notice as defined in the engagement agreement.
Failure to attend scheduled sessions without notice may result in forfeiture of that session.
Enterprise engagements are governed by agreed cancellation terms in writing.
We treat client information as confidential and will not disclose proprietary or sensitive business information except:

Where required by law
Clients agree not to disclose proprietary frameworks, diagnostic methodologies, internal facilitation structures, or materials shared during engagements.
Where required, mutual confidentiality agreements may be executed.
Clients are responsible for:
Providing accurate and complete information.
Ensuring participant consent where assessments are used.
Ensuring lawful authority to engage services.
Implementing recommendations at their discretion.
Coaching and advisory services support decision-making but do not replace executive accountability.
We do not guarantee specific business, financial, or organizational outcomes.
Executive coaching and personal coaching services are professional development services.
They are not:
Psychotherapy
Mental health treatment
Medical services
If a client requires licensed psychological or medical support, they should seek appropriate professionals.
Personal data is processed in accordance with our Privacy Policy.
For enterprise engagements involving employee data, roles (data controller vs data processor) will be defined contractually where required.
To the fullest extent permitted by law:
We are not liable for indirect, incidental, or consequential damages.
Total liability shall not exceed the fees paid for the specific service giving rise to the claim.
All services are advisory in nature.
Certain services may involve third-party platforms (e.g., TRACOM systems, payment processors, analytics providers).
Use of those platforms is subject to their respective terms and policies.
We are not responsible for third-party platform operations.
These Terms are governed by the laws of Romania and applicable European Union law.
Disputes shall be subject to the jurisdiction of the competent courts in Romania unless otherwise required by mandatory law.
We may update these Terms periodically. Updates will be published with a revised effective date.
Continued use of our services constitutes acceptance of the updated Terms.
